Plain-English summary

• Day Pal is a wellness app, not a medical device. Always talk to a doctor about medical decisions.
• AI estimates are estimates: confirm your portions if accuracy matters.
• Subscriptions auto-renew through Apple or Google and can be cancelled at any time. There is no free trial.
• You keep ownership of your food log, photos, and content. You give us a limited licence to operate the service.
• Don’t abuse the service: no scraping, no reselling, no harassing other users, no medical-advice claims.
• If something goes wrong, our liability is capped at what you paid us in the last 12 months (or USD 100, whichever is higher).

Acceptance of these terms

By creating a Day Pal account, downloading the app, or using our website, you agree to these Terms of Service and to our Privacy Policy. If you don't agree, please don't use the service.

Who can use Day Pal

• You must be at least 16 years old.
• You must have the legal capacity to enter into a binding contract.
• You must not be barred from using the service under the laws of your jurisdiction.
• Day Pal is not designed for users with active eating disorders. If calorie tracking is harmful to you, please stop using the app and seek support from a qualified professional.

Wellness, not medical advice

Day Pal is a wellness and nutrition-tracking tool. It is not a medical device, not a substitute for medical advice, diagnosis, or treatment, and not a substitute for the judgement of a qualified healthcare professional.

Calorie targets, macro targets, and AI Coach guidance are informational. Always consult a doctor, dietitian, or other qualified professional before making medical or dietary decisions, especially if you are pregnant, nursing, have a chronic health condition (diabetes, eating disorders, kidney disease, etc.), or take medication that depends on food intake (such as insulin).

Your account

You are responsible for keeping your login credentials secure and for everything that happens under your account. Tell us immediately at hello@getdaypal.com if you suspect unauthorised access. You may have only one personal account.

Subscriptions & billing

• Free tier. The free tier is available without payment, with usage limits described in-app. We may change those limits with reasonable notice.
• Premium. Day Pal Pro plans (weekly, monthly, annual) unlock additional features. Pricing is shown in the app and on this website before purchase, in your local currency where supported.
• No free trial. We don't run free trials of any length. You're charged for the plan you pick when you subscribe, and we always show the price before you buy.
• Auto-renewal. Weekly, monthly, and annual subscriptions auto-renew at the end of each period at the then-current price. You can turn off auto-renewal at any time (see Cancellation).
• Where billing happens. All subscriptions are billed by Apple (App Store) or Google (Play Store) under their own terms. There is no other way to pay us, and we never see your payment-card number.
• Taxes. Prices include VAT or sales tax where required by law; otherwise, Apple or Google add them at purchase.

Cancellation & refunds

• Cancel any time, in two taps. For App Store subscriptions, open Settings → your name → Subscriptions → Day Pal. For Play Store, open Play Store → Profile → Payments & subscriptions → Subscriptions. Those are the only two places a subscription can exist, so there is nowhere else to cancel.
• Refunds. Apple and Google are the seller for every subscription, so they handle refunds and any statutory right of cancellation you have where you live. We can't process a store refund ourselves, but tell us and we'll help you raise it with them.
• No fake-discount tactics. We won't use countdown timers that reset, fake "limited" pricing, or hidden trial-to-paid conversions.

AI features & estimates

Photo, voice, and text logging use machine learning, and the adaptive Coach engine derives its daily move from aggregate adherence stats (not from individual user content). The output is an estimate, not a measurement. Estimates can be wrong, sometimes substantially so. Always confirm portions before logging if accuracy matters (medication dosing, allergen-sensitive eating, athletic prep, clinical contexts).

We do not warrant that AI outputs are accurate, complete, or suitable for any purpose, and we do not accept liability for decisions you make based on them. Confidence scores shown in-app are guidance only.

Your content & licence to us

You own the photos, food entries, recipes, weights, and other content you create in Day Pal ("Your Content"). To run the service, you grant us a worldwide, non-exclusive, royalty-free licence to host, copy, and process Your Content solely to deliver the service to you, and, only with your anonymisation consent, to improve our models in aggregated form.

We'll never publish, sell, or use Your Content for advertising. The licence ends when you delete the content or your account, except to the extent we have to retain copies for legal reasons or in routine backups (which expire on rotation).

Acceptable use

You agree not to:

• Reverse-engineer, decompile, or attempt to extract source code, except where the law expressly permits it.
• Scrape the API, bulk-download data, or build a competing service with our outputs.
• Abuse AI endpoints: for example, sending non-food images to consume credits, automating prompt-injection, or attempting to extract underlying model behaviour.
• Use Day Pal to harass others, share illegal content, or violate anyone's rights.
• Misrepresent the app as offering medical advice, diagnosis, or treatment.
• Create accounts using automated means, share an account commercially, or resell access.

Our intellectual property

The Day Pal name, logo, app, website, source code, models, training data, prompt templates, and design are owned by Day Pal or our licensors and are protected by copyright, trademark, and other laws. We grant you a limited, non-transferable, revocable licence to use the app for personal, non-commercial purposes, subject to these terms.

Third-party services

Day Pal integrates with Apple Sign-in, Google Sign-in, and AI providers (Anthropic, OpenAI). Paid plans are billed through Apple and Google in-app purchase. Your use of those services is governed by their own terms and privacy policies. We're not responsible for them.

Suspension & termination

You can delete your account at any time from Settings → Privacy → Delete account. Your data is wiped within 30 days, except records we're required to keep by law.

We can suspend or terminate your account if you materially breach these terms, abuse the service, or use it in a way that puts other users or our infrastructure at risk. Where reasonable, we'll warn you and give you a chance to fix the issue first. If we terminate your paid subscription for breach, no refund is owed; if we terminate without cause, we'll refund the unused portion.

Disclaimers

To the maximum extent permitted by law:

The service is provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the service will be uninterrupted, secure, or error-free, that defects will be corrected, or that AI outputs will be accurate.

Nothing in these terms excludes or limits liability that cannot legally be excluded, including, in many jurisdictions, liability for death or personal injury caused by negligence, fraud, or statutory consumer rights.

Limitation of liability

To the maximum extent permitted by law, Day Pal and its officers, employees, and contractors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, goodwill, or other intangible losses, arising out of or in connection with your use of (or inability to use) the service.

Our aggregate liability for any claim arising out of or in connection with the service is limited to the greater of (a) the amount you paid us in the 12 months before the event giving rise to the claim, or (b) USD 100. Some jurisdictions don't allow these limits, in which case they apply only to the extent the law permits.

Indemnity

You agree to indemnify and hold Day Pal harmless from any claim, loss, or expense (including reasonable legal fees) arising from (a) your breach of these terms, (b) your misuse of the service, or (c) Your Content, to the extent permitted by law.

Disputes & governing law

We'd much rather solve a dispute by talking. Please email hello@getdaypal.com first and give us 30 days to make it right.

These terms are governed by the laws of the jurisdiction where Day Pal is established, without regard to conflict-of-laws rules. If you are a consumer, you also benefit from the mandatory consumer-protection laws of the country where you live, and nothing in these terms removes those protections. EU consumers may also use the European Commission's online dispute-resolution platform at ec.europa.eu/consumers/odr.

Changes to these terms

We may update these terms over time. The "Last updated" date at the top will reflect any change. For material changes we'll notify you in-app or by email at least 14 days before they take effect. Continued use after the effective date means you accept the new terms; if you don't, you can cancel and delete your account.
